  1. Acceptance of Terms

By accessing and using the Realms of Echos platforms, including the Minecraft server, Discord server, website with forums, and store page (collectively referred to as "Platforms"), you agree to comply with and be bound by these Terms & Conditions (hereafter referred to as "Terms"). If you do not agree with these Terms, you are prohibited from using or accessing these Platforms. Your use of the Platforms constitutes acceptance of these Terms and establishes a contractual agreement between you and Realms of Echos.

 

  1. User Accounts and Whitelisting

Account Creation: Users are required to create an account through our Xenforo-based forums. By creating an account, you agree to provide accurate, current, and complete information during the registration process and update such information to keep it accurate, current, and complete. All accounts are stored securely in accordance with our Privacy Policy, which complies with relevant data protection laws, including the California Consumer Privacy Act (CCPA) and the General Data Protection Regulation (GDPR) where applicable.

 

Whitelisting Requirements: Access to the Minecraft server, broader forums, and Discord server is restricted to whitelisted users. To gain whitelisting, users must submit a detailed application through the Realms of Echos website. This application process includes a review by server administrators, and only those approved will gain access to all Platforms. Realms of Echos reserves the right to deny or revoke access at its sole discretion.

 

  1. Eligibility

Age Requirement: Participation in Realms of Echos is strictly limited to users who are eighteen (18) years of age or older. By creating an account and participating in any of our Platforms, you confirm that you meet this age requirement. Users under the age of eighteen (18) are not permitted to create an account. Users under the age of eighteen (18) are not permitted to access the Platforms starting November 1st, 2026.

 

  1. Content Ownership and Intellectual Property

User-Created Content: Any content, including but not limited to builds, mods, art, writing, and forum posts, created, shared, or otherwise contributed by users on Realms of Echos Platforms is credited to the original author or creator. By contributing content, users grant Realms of Echos a perpetual, irrevocable, non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, distribute, publicly display, and create derivative works from such content. Realms of Echos reserves the right to use or repurpose this content for any reason, including but not limited to marketing, promotion, and further development of the Platforms. Users waive any moral rights or claims for compensation or further approval regarding the use of their content by Realms of Echos. Exceptions apply to contractual and binding agreements that are explicitly established between users and Realms of Echos.

 

  1. Purchasing and Refunds

Purchases: All purchases made through the Realms of Echos store page are final and non-refundable, except as otherwise stated in these Terms. By completing a transaction on the store page, you agree to provide accurate payment information and authorize Realms of Echos to charge the specified amount to your payment method.

 

Refunds: Refunds are only provided if the product or service delivered does not match what was promised at the time of purchase. Refund requests must be submitted in writing to thomas@realmsofechos.com within fourteen (14) days of the purchase date, detailing the nature of the discrepancy. Realms of Echos will evaluate refund requests on a case-by-case basis in compliance with United States consumer protection laws, including the Federal Trade Commission (FTC) regulations, 15 U.S.C. §§ 45.

 

  1. Server and Platform Availability

Downtime and Maintenance: Realms of Echos does not guarantee continuous or uninterrupted availability of its Platforms. Scheduled maintenance, updates, or technical issues may result in temporary downtime, during which the Platforms may be inaccessible. Users acknowledge that downtime may occur without prior notice, and Realms of Echos will not be liable for any inconvenience or loss arising from such downtime.

 

Termination or Discontinuation of Service: Realms of Echos reserves the right to terminate or discontinue any of its Platforms, in part or in full, at any time without prior notice. In the event of termination or discontinuation, users will not be entitled to any compensation, reimbursement, or refund for resources, purchases, or content contributed to the Platforms.

 

  1. Modification of Terms

Right to Modify: Realms of Echos reserves the right to modify, amend, or update these Terms at any time, at its sole discretion. Any changes to the Terms will be communicated to users via the website, email, or other appropriate channels. It is the responsibility of users to review the updated Terms. Continued use of the Platforms after any modifications constitute acceptance of the revised Terms.

 

Effective Date of Changes: Modifications to these Terms will become effective on the date they are posted unless otherwise stated. If you do not agree with the updated Terms, you must cease using the Platforms immediately.

 

  1. Disciplinary Actions

Violation Consequences: Violations of these Terms, or any other rules and policies set forth by Realms of Echos, may result in disciplinary actions, including but not limited to warnings, temporary or permanent bans from the Platforms, and removal from the community. Realms of Echos retains the right to determine the severity and consequence of any violation.

 

Non-Refundable Resources: Any resources, including but not limited to in-game items, virtual currency, or services, provided to or purchased from Realms of Echos are non-refundable and non-returnable upon disciplinary action. Users acknowledge that disciplinary actions are at the sole discretion of Realms of Echos.

 

  1. Termination of Access

Termination Rights: Realms of Echos reserves the right to terminate any user’s access to its Platforms, including the Minecraft server, Discord server, website, and store, at any time, with or without cause and with or without notice. Reasons for termination may include, but are not limited to, violations of these Terms, inactivity, or disruptive behavior.

 

Effect of Termination: Upon termination, users will lose access to all accounts, content, and privileges associated with the Platforms. Realms of Echos will not be liable for any loss or damages resulting from the termination of access.

 

  1. Limitation of Liability

No Warranty: The Platforms are provided on an "as-is" and "as available" basis. Realms of Echos makes no representations or warranties of any kind, express or implied, as to the operation of the Platforms, or the information, content, materials, or products included on the Platforms.

 

Limitation of Damages: To the fullest extent permitted by applicable law, Realms of Echos shall not be liable for any damages of any kind arising from the use of or inability to use the Platforms, including but not limited to direct, indirect, incidental, punitive, and consequential damages. This limitation applies regardless of whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, and even if Realms of Echos has been advised of the possibility of such damages.

 

No Liability for Data Loss: Realms of Echos is not liable for any data loss, account bans, or other disruptions resulting from the use of its Platforms. Users are solely responsible for maintaining backups of any important data or content they wish to retain.

 

  1. Governing Law

Jurisdiction: These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the federal and state courts located in the United States. Users agree to submit to the personal jurisdiction of these courts for the resolution of any disputes.

 

  1. Dispute Resolution

Resolution Process: Any disputes related to the use of Realms of Echos Platforms should be directed to the administration by contacting thomas@realmsofechos.com. Realms of Echos will make reasonable efforts to resolve any issues promptly and fairly through direct communication.

 

Arbitration Agreement: In the event that a dispute cannot be resolved through informal means, users agree to submit the dispute to binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration will take place in the jurisdiction agreed upon by both parties. The decision of the arbitrator shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
